ANI Copyright Suit: Delhi HC Seeks OpenAI’s Response

The Sam Altman-led company said in a response to Delhi HC last week, that it does not use the content of Indian media groups to train its AI chatbot ChatGPT and holds no obligation to form partnerships with media outlets to use publicly available content

The Delhi High Court has reportedly asked OpenAI to file a response regarding an application filed by the Indian Music Industry (IMI) that sought to intervene in a suit filed by Asian News International (ANI).

The lawsuit accuses OpenAI of unauthorised use of ANI’s content to train and operate ChatGPT.

As per ET’s report, during the hearing Justice Amit Bansal also mentioned that the HC cannot expand the scope of the lawsuit indefinitely. “We can’t keep expanding the scope of the suit; you can file your own suit. Hundreds of industries may be affected by it,” said Bansal.

On Friday (February 14), it was reported that major music labels including the likes of T-Series, Saregarama and Sony were looking to join the ongoing copyright lawsuit against the ChatGPT developer in Delhi HC.

Many Indian publishers and media groups joined ANI, after it filed a lawsuit against the Sam Altman-led company last year in November with the Delhi HC.

It is pertinent to note that the company said in a response to Delhi HC last week, that it does not use the content of Indian media groups to train its AI chatbot ChatGPT and holds no obligation to form partnerships with media outlets to use publicly available content.

Following the lines of the news agency, a host of Indian and foreign publishers including Rupa Publications, S Chand and Co, Bloomsbury, Penguin Random House, Cambridge University Press and Pan Macmillan banded together to sue OpenAI for copyright infringement.

Later, even media houses like NDTV, Network18, the Indian Express and the Hindustan Times approached the Delhi HC to join the ongoing lawsuit against the company.

After publishers and media groups threw allegations against the company, in a response it asked the HC to dismiss Indian publishers’ plea as it provides book summaries and extracts from unlicensed copies and uses publicly available data protected by fair use principles.

Additionally, the company also argued that India courts do not have the jurisdiction to hear the copyright infringement cases against them citing its lack of presence in the country and its inability to delete any data on which their AI models have been trained under the laws of the US.
